Negotiations Excellence

No two negotiations are the same. Political (internal or external), economic, environmental, and a variety of other factors will present themselves in different ways in different negotiations. You cannot control these variables, no matter how talented a negotiator you are. What you can influence, and control is how you prepare for the pending negotiation, how you present yourself as a negotiator, and how you offer acceptable solutions that, ultimately, work for all parties. This session will identify your negotiation style, lay the groundwork for strategic negotiation analysis and preparation, and provide a guideline for managing the negotiation process and closing with a mutually beneficial mindset.

Speakers

Joanna Shea

Joanna Shea has over 17 years of commercial and project negotiations experience in the natural resource, utilities, and infrastructure sectors. During that time, she has led over $2 billion worth of acquisitions, divestments, and contract negotiations. She has project managed and negotiated agreements linked to over $1 billion in capital projects in both Canada and the United States, and held senior leadership roles in negotiations, project management, resource development, and organizational restructuring. Joanna has a B.Com. from St. Francis Xavier University, is a graduate of British Petroleum’s intensive in-house Conflict and Negotiations training course, holds a graduate certificate in project leadership from Cornell University and a graduate certificate in negotiations from the Harvard School of Business. She is a co-founder of the Negotiations Collective.


Trials and Tribulations - The Professional Liability Insurance Claim

This session will provide insight with real examples of professional liability claims and lawsuits (errors and omissions) experienced by registrants, followed by a discussion on recent legal trends and defense arguments, and the typical obligations of reporting claims and lawsuits to insurance companies. Our presenters will also review risk management tips that assist in mitigating future lawsuits and defending allegations of errors and omission against the registrant.

Daniela Fuda

Daniela is the Director, Specialty Lines Complex Claims at Berkley Canada. A lawyer by training, Daniela joined Berkley Canada in 2016 and is a Director in the Claims group. Daniela’s primary focus is centered around working on complex claims arising out of Berkley's specialty products, which includes errors and omissions, directors and officers, technology and cyber, life sciences, employment practices, and environmental. Prior to joining Berkley, Daniela practiced as a lawyer in New York for 11 years. She has successfully represented insurance carriers and acted as coverage and monitoring counsel. Daniela is a standing member of both New York and Connecticut bars.

Madison Britz

Madison Britz is the Assistant Vice President, Associate Client Executive at Marsh Canada. Madison obtained her bachelor’s degree from the University of Victoria and has a background in various professional liability products. Madison’s primary role is working on the Engineers and Geoscientists BC Affinity program for professional lability insurance, along with various standalone professional liability policies. She is specialized in Errors and Omission Placement and her main focus is now offering support and placing coverage for various engineers and geoscientists. Madison brings 4 years of experience to the team and has proven her abilities in the retention of key professional liability clients with Marsh Canada.

Marlowe Mercado

Marlowe Mercado, B.A., CAIB, is Vice President, Client Executive in the Commercial Lines Unit of Marsh Canada. He holds a Canadian Accredited Insurance Broker (CAIB) Designation and is working towards his CIP Designation (Chartered Insurance Professional). Marlowe is a trained diplomat with a degree in international relations and business. He specializes in professional lines insurance with 11 years of experience working in both North American and Asian insurance markets. His role is the upkeep and placement work on the Engineers and Geoscientists BC Affinity program. Marlowe brings a fresh perspective to the team with his multinational experience and local market understanding.
