Ethics in Practice: Professional Conduct Between Submitting Professionals and Authorities Having Jurisdiction

In September 2023, Engineers and Geoscientists BC published a practice advisory on Professional Conduct Between Submitting Professionals and Authorities Having Jurisdiction. This practice advisory addresses common communication challenges that arise between Submitting Professionals and AHJs during the approval and/or submissions processes. This session will provide an overview of the content of the advisory including practical considerations related to communication issues, and some lessons learned through situations we've handled through practice advice inquiries.

Speakers

Alice Kruchten, P.Eng.

Alice is a registered professional engineer and Practice Advisor with Engineers and Geoscientists BC. In her current role as Practice Advisor at Engineers and Geoscientists BC, Alice is responsible for managing the development of the organization's professional practice guidelines, engaging with various stakeholders to address professional practice concerns, and for providing advice to registrants regarding practice issues. Alice is an environmental engineer with 8 years' experience in civil engineering and environmental consulting in BC. She holds a Bachelor of Applied Science (in Civil Engineering), and a Master of Engineering Leadership (in Integrated Water Management Engineering), both from the University of British Columbia.

Amy Fehr, P.Eng.

As Manager of the Professional Practice Advice Program, Amy is responsible for overseeing a team that assists registrants with professional practice related issues. This includes practice advice services, practice guideline development, advisory group support, and external party engagement regarding practice issues that affect registrants. Ms. Fehr is a registered professional engineer with experience in various fields related to civil engineering. She holds a Bachelor of Science in Civil Engineering from the University of Saskatchewan. She spent over 15 years as a consulting engineer performing roles related to structural engineering, hydrotechnical engineering, and quality management before joining Engineers and Geoscientists BC in 2017. Her background in consulting gives her a solid understanding of many practice issues facing registrants and allows her to bring an efficient and constructive approach to her work.


Managing Professional Liabilities

3:00 PM - 4:00 PM

The session will provide insight on real examples of Professional Liability (Errors and Omissions) claims/lawsuits experienced by registrants. Further discussion involves not only examples of errors and omissions lawsuits against the registrant, but recent legal trends and defense arguments that were made. Session will also outline the typical obligations of reporting claims/lawsuits to the Insurance Company, and Risk Management tips that may assist in mitigating future lawsuits, but also assist in the defense of allegations of Errors and Omissions against the registrant.

Daniela Fuda

Daniela is the Director, Specialty Lines Complex Claims at Berkley Canada. A lawyer by training, Daniela joined Berkley Canada in 2016 and is a Director in the Claims group. Daniela’s primary focus is centered around working on complex claims arising out of Berkley's specialty lines products, which includes errors and omissions, directors and officers, technology and cyber, life sciences, employment practices, and environmental. Prior to joining Berkley, Daniela practiced as a lawyer in New York for eleven years. She has successfully represented insurance carriers and acted as coverage and monitoring counsel. Daniela is a standing member of both New York and Connecticut bars.

Madison Britz

Madison Britz is the Assistant Vice President, Associate Client Executive at Marsh Canada. Madison obtained her Bachelor’s Degree from the University of Victoria and has a background in various Professional Liability products. Madison’s primary role is working on the EGBC Affinity program for Professional Lability Insurance, along with various standalone Professional Liability policies. She is specialized in E and O Placement and her main focus is now offering support and placing coverage for various Engineers and Geoscientists. Madison brings 4 years of experience to the team and has proven her abilities in the retention of key clients in the amalgamation of portfolio of clients of Professional Liability into Marsh Canada.

Marlowe Mercado

Marlowe Mercado, B.A., CAIB is Vice President, Client Executive in the Commercial Lines Unit of Marsh Canada. He holds a Canadian Accredited Insurance Broker (CAIB) Designation and is working towards his CIP Designation (Chartered Insurance Professional). Marlowe is a trained diplomat with a degree in international relations and business. He specializes in Professional Lines Insurance with 11 years of experience working in both North American and Asian Insurance Markets. His role is the upkeep and placement work on the EGBC Affinity program. Marlowe brings a fresh perspective to the team with his multinational experience and local market understanding.

Sherry Chen

Sherry Chen is a Senior Professional Liability and Cyber Underwriter at Berkley Canada, and the primary underwriting contact for the EGBC/APEG Insurance program. With a career spanning over 10 years, she has extensive experience on the topic of Architects, Engineers and Contractors’ Professional Liability underwriting which includes both program-structured business for small-to-medium sized enterprises as well as stand-alone Professional Liability insurance for multi-million dollar, international A and E firms. She is passionate about helping her broker partners and Insureds with their risk management strategy and de-mystifying the concept of Professional Liability Insurance.
